KUALA LUMPUR: “Saya dengar macam bunyi letupan sebelum meliaht datu tubuh manusia di atas lantai bangunan,” kata Hamzah Sharif,45, menceritakan kejadian seorang pelajar lelaki Universiti Malaya (UM) yang dipercayai terjatuh dari tingkat 16, Apartmen Vista Angkasa, Kampung Kerinchi di sini, pagi semalam.

Dalam kejadian kira-kira jam 11.30 pagi itu, mangsa, Tan Kian Chong,22, ditemui dalam keadaan tertiarap dengan keadaan kepalanya berkecai dan kesan darah terpercik hingga ke tingkat dua bangunan apartmen berkenaan.

Pelajar UM maut jatuh tingkat 16

KUALA LUMPUR: Seorang pelajar lelaki Fakulti Sains Universiti Malaya (UM), maut selepas jatuh daripada Tingkat 16, Blok 5 Apartmen Vista Angkasa di Kerinchi di sini, pagi semalam.

Mangsa dikenali sebagai Tan, 22, ditemui tertiarap jam 11.30 pagi dalam keadaan mengerikan dengan badan berlumuran darah dan kepala pecah di tempat letak motosikal.

Ketua Polis Daerah Brickfields, Asisten Komisioner Wan Abdul Bari Wan Khalid, berkata polis menerima panggilan berhubung penemuan mayat mangsa daripada orang awam kira-kira jam 12 tengah hari.

Beliau berkata, siasatan awal mendapati mangsa berasal dari Muar, Johor berdasarkan kad pengenalan ditemui dalam beg yang ditinggalkan di koridor Tingkat 16 apartmen itu.

“Mangsa dipercayai terjatuh dari bangunan itu berdasarkan penemuan barang miliknya termasuk sebuah beg dan cermin mata yang ditinggalkan di Tingkat 16. Polis juga menjumpai kad pelajar yang tertera tahun 2006/2007.

“Mungkin mangsa masih belajar di universiti berkenaan, tapi tidak memperbaharui kad atau sudah tamat belajar. Kita akan terus menjalankan siasatan walaupun kes ini diklasifikasikan sebagai mati mengejut (SDR),” katanya di sini, semalam.

Difahamkan, turut terdapat di dalam beg yang ditemui itu adalah nota kuliah milik mangsa.

Mayat mangsa dihantar ke Pusat Perubatan Universiti Malaya (PPUM) untuk bedah siasat dan polis juga sudah memaklumkan kejadian itu kepada keluarga mangsa di Johor.

In Roberts @ Kamarulzaman v Umi Khalthum, the spouses had bought a matrimonial home for RM50,000. The husband contribute RM40,000 and the wife RM10,000. The house was named under the wife. After the dissolution of marriage or divorce, the husband apply that the house to be divided equally among them. The wife was not agree to this claims. The court held that the asset must be divided equally among them.
In Boto v Jaafar, the husband and wife was marry in 1966. During the subsistence of marriage, they was bought a house, a piece of land, four fishing boats and one fish stall. The husband run a fishing business. After the divorce, the wife was claim the Harta Sepencarian.

Salleh Abas CJ held that the assets must be divided among them although the wife was not contribute to bought that assets. The wife was give an indirect contribution as she responsible to keep the peace of mind of to her husband to run the fishing business with proper sense. The court held that one-third of the assets was divide to the plaintiff and two-third for the defendant. The one-third division is for the indirectly contribution by the plaintiff to support the plaintiff’s fishing business.
